Νομοθετική κύρωση της Τεχνικής Διευθέτησης μεταξύ του Υπουργού Αμυνας της Γαλλικής Δημοκρατίας και του Ανωτάτου Στρατηγείου Συμμαχικών Δυνάμεων Ευρώπης (SHAPE), που αφορά στην Επάνδρωση, Χρηματοδότηση, Διοίκηση και Υποστήριξη του Στρατηγείου Διοικήσεως Ναυτικής Δυνάμεως Γαλλίας, με την ιδιότητα του Στρατηγείου Διοικήσεως Ναυτικής Δυνάμεως Ταχείας Αναπτύξεως του NATO.

Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή:

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Τεχνική Διευθέτηση μεταξύ του Υπουργού Αμυνας της Γαλλικής Δημοκρατίας και του Ανωτάτου Στρατηγείου Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) για την Επάνδρωση, Χρηματοδότηση, διοίκηση και υποστήριξη του Στρατηγείου Διοικήσεως ΝαυτικήςΔυνάμεωςΓαλλίας [(Headquarters Commander French Maritime Force (HQ COMFRMARFOR)] με την ιδιότητα του Στρατηγείου Διοικήσεως Ναυτικής Δυνάμεως ΤαχείαςΑναπτύξεωςτου NATO (Headquarters NATO Rapid Deploy-able Maritime Component Command/HQ NRDMCC), η οποία υπογράφηκε στις 7 Νοεμβρίου 2005 στο Παρίσι για το Υπουργείο Αμυνας της Γαλλικής Δημοκρατίας και στις 29 Νοεμβρίου 2005 στο SHAPE/Μονς Βελγίου για το Ανώτατο Στρατηγείο Συμμαχικών Δυνάμεων Ευρώπης, σε δύο κείμενα, τα οποία σε πρωτότυπο στην αγγλική και γαλλική γλώσσα και σε μετάφραση στην ελληνική, έχουν ως εξής:

Εχοντες υπόψη τη Σύμβαση της 19ης Ιουνίου 1951 μεταξύ των Συμβαλλομένων Μερών του Βορειοατλαντικού Συμφώνου περί του καθεστώτος των δυνάμεων τους (SOFA του NATO) και τη Σύμβαση της 19ης Ιουνίου 1955 μεταξύ των Κρατών – μελών του Βορειοατλαντικού Συμφώνου και των λοιπών συμμετεχόντων στη Συνεργασία για την ειρήνη Κρατών περί του καθεστώτος των δυνάμεων τους (SOFA του PfP). Εχοντες υπόψη τη Σύμβαση μεταξύ των Κρατών – μελών της Ευρωπαϊκής Ενώσεως περί του καθεστώτος του στρατιωτικού και πολιτικού προσωπικού αυτών, αποσπασμένου στα θεσμικά όργανα της Ευρωπαϊκής Ενώσεως, στα αρχηγεία και στις στρατιωτικές δυνάμεις που τίθενται στη διάθεση της Ευρωπαϊκής Ενωσεως και στα αρχηγεία και στις στρατιωτικές δυνάμεις που είναι δυνατόν να τεθούν στη διάθεση αυτής στο πλαίσιο της προπαρασκευής και της ασκήσεως των καθηκόντων που αναφέρονται στο Αρθρο 17 (2) της Συνθήκης για την Ευρωπαϊκή Ενωση, συμπεριλαμβανομένων εκείνων κατά τη διάρκεια των ασκήσεων, και περί του καθεστώτος του στρατιωτικού και πολιτικού προσωπικού των Κρατών – μελών που τίθενται στη διάθεση της Ευρωπαϊκής Ενώσεως για να ενεργούν στο πλαίσιο αυτό (SOFA της ΕΕ), η οποία υπεγράφη στις Βρυξέλλες, στις 17 Νοεμβρίου 2033.

Εχοντες υπόψη ότι, όπως απεφασίσθη στο (οριστικό) έγγραφο MC Μ 7 1, το οποίο ενεκρίθη στις 8 Ιουλίου 2002, το Βορειοατλαντικό Συμβούλιο ενέκρινε τη “δομή των δυνάμεων του NATO” και απεφάσισε ότι, όταν τα ενδιαφερόμενο, αοχηγεία θα ανταποκρίνονται στο σύνολο των εγκεκριμένων κριτηρίων στρατιωτικής φύσεως τα οποία διέπουν τα Στρατηγεία Δυνάμεων υψηλού επιπέδου προετοιμασίας / δυνάμεων χαμηλότερου επιπέδου προετοιμασίας (HRF/FLR), όπως ορίζονται στα έγγραφα IMSM-950-00 και IMSM-848-00, θα ονομάζονται, κατόπιν αξιολογήσεως από τα Στρατηγεία. Εχοντες υπόψη ότι, σύμφορα με το (οριστικό) έγγραφο MC 317/1, το οποίο ενεκρίθη στις 8 Ιουλίου 2002, η Στρατιωτική Επιτροπή απεφάσισε όπως τα εν λόγω δυνάμενα να αναπτυχθούν Στρατηγεία θα τύχουν εθνικής ή πολυεθνικής χρηματοδοτήσεως

Εχοντες υπόψη την πρόταση της Γαλλίας, η οποία διετυπώθη από τον Αρχηγό του Γενικού Επιτελείου Στρατού (CEMA) στις 30 Ιουνίου 2003, εξέλαβε συγκεκριμένη μορφή στο μνημόνιο 2875/RMF/CM/OTAN/M2/DRO της 1ης Οκτωβρίου 2003 και έγινε αποδεκτή από τον Ανώτατο Συμμαχικό Διοικητή Ευρώπης (SACEUR) στις 10 Νοεμβρίου 2003, με την επιστολή με αριθμό πρωτοκόλλου 3050/SHPXA/0510/03- 99899 (η οποία περιελήφθη στο διορθωτικό κείμενο 11 του εγγράφου IMSM-580-00 της 20ής Νοεμβρίου 2003).

Εχοντες υπόψη τη συμφωνία η οποία υπεγράφη στις 5 Μαΐου 2004 μεταξύ του Ανώτατου Συμμαχικού Διοικητή Ευρώπης (SACEUR) και του τον Αρχηγού του Γενικού Επιτελείου Στρατού (CEMA) σχετικά με τον σχεδιασμό και τη διεξαγωγή των επιχειρήσεων.

Εχοντες υπόψη την πρόταση της Γαλλίας όπως τεθεί το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), στην Τουλόν της Γαλλίας, στη διάθεση της δομής δυνάμεων του NATO, Βεβαιώνοντας ότι η κατάσταση προσωπικού του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), είναι σύμφωνη προς τον μετασχηματισμό της Συμμαχίας και τη συμμετοχή της Γαλλίας στη Δύναμη Αντιδράσεως του NATO (NRF). Σε απάντηση του αιτήματος της Στρατιωτικής Επιτροπής περί θεσπίσεως ειδικών ρυθμίσεων για τη διοίκηση και τον έλεγχο εκάστου Στρατηγείου, ώστε να προσδιορισθεί κατά πόσο είναι διαθέσιμο σε περίοδο ειρήνης και σε περίοδο κρίσεως, καθώς και κατά τη διεξαγωγή επιχειρήσεων.

Αναγνωρίζοντας την αρχή βάσει της οποίας το Στρατηγείο είναι ανοικτό στα Κράτη τα οποία ενεργούν ως Κράτη – μέλη του NATO ή της Ευρωπαϊκής Ενώσεως.

Θεωρώντας ότι, πέραν του ρόλου του στο πλαίσιο του NATO, το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), δύναται να αναλαμβάνει εθνικές αποστολές ή αποστολές της Ευρωπαϊκής Ενώσεως. Τα Συμβαλλόμενα Μέρη αποφασίζουν τις ακόλουθες διατάξεις :

TECHNICAL ARRANGEMENT BETWEEN THE MINISTER OF DEFENCE OF THE FRENCH REPUBLIC AND THE SUPREME HEADQUARTERS ALLIED POWERS EUROPE (SHAPE) CONCERNING THE MANNING, FUNDING, ADMINISTRATION AND SUPPORT OF HEADQUARTERS COMMANDER FRENCH MARITIME FORCE (HQ COMFRMARFOR) AS HEADQUARTERS NATO RAPID DEPLOYABLE MARITIME COMPONENT COMMAND (HQ NRDMCC) TABLE OF CONTENTS ARTICLE PAGE NO. Model Note of Accession to the Technical Arrangement Considering the North Atlantic Treaty of 4 April 1949: and especially the provisions regarding the efforts for collective defence, Considering the European Union (EU) Treaty in the version resulting from the treaty of26m February 2001, Considering the Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces dated 19th June 1951 (NATO SOFA), and the Agreement among the states parties to the North Atlantic Treaty and the other states participating in the Partnership for Peace regarding the status of their forces of 1991 June 1995 (PfP SOFA), Considering the Agreement between the member states of the European Union concerning the status of the military and civilian staff seconded to the institutions of the European Union, of the headquarters and forces which may be made available to the European Union in the context of the preparation and execution of the tasks set out in Article 17(2), of the Treaty on European Union, including exercises, and the military and civilian staff of the member states put at the disposal of the European Union to act in this context, signed in Brussels on 17th November 2003 (EU SOFA), Considering that, in accordance with MC 317/1 (Final) approved on 8m July 2002, the North Atlantic Council (NAC) approved the NATO force structure and directed that when these headquarters meet the full set of agreed military criteria for High Readiness Forces / Forces of Lower Readiness (HRF/FLR) HQs as approved in IMSM-950-00 and IMSM-84S-00 and, after an evaluation by the Strategic Commands, HQs will be selected and granted the title of : NATO RAPID DEPLOYABLE MARITIME COMPONENT COMMAND (NRDMCC HQ) Considering that under MC-317/1 1 (Final) approved on 8th July 2002, the Military Committee directed that such deployable Headquarters were to be funded on a national or multinational basis, Considering the French proposal made by the Chief of Staff of the French Armed Forces (CEMA) on 30th June 2003, detailed in memorandum n° 2875/RMF/CM/OTAN/M2/DRO of 1st October 2003 and agreed by the Supreme Allied Commander Europe (SACEUR) on 10th November 2003 in letter 3050/SHPXA/0510/03- 99899 (included in corrigendum 11 to 1MSM-580-OO dated 20th November 2003), Considering the agreement between SACEUR and CEMA on the planning and conduct of operations, signed on 5th May 2004, Considering France`s proposal that HQ COMFRMARFOR, located at Toulon (France), be made available to the NATO Force Structure, Affirming that the establishment of HQ COMFRMARFOR is in keeping with the transformation of the Alliance and with France`s participation in the NATO Response Force (NRF), In response to the Military Committee`s request that specific arrangements concerning command and control (C2) be established for each Headquarters in order to determine the availability of C2 in times of peace and crisis, and during operations, Recognizing the principle that the Headquarters is open to states in their capacity as member states of NATO or of the European Union, Considering that in addition to its commitment to NATO, national or Eiuropean Union tasks may be assigned to HQ COMFRMARFOR, The Parties have agreed as follows: Article Ι Definitions In this arrangement, the terms below are defined as follows: 1.1. “HQ COMFRMARFOR”: the Commander French Maritime Force military headquarters whose composition is specified in Annex A. 1.2. “Signatories”-, the framework nation and the Supreme Headquarters Allied Powers Europe (SHAPE). 1.3. “Host nation”: France, on whose sovereign territory HQ COMFRMARFOR is established. 1.4. “Framework nation”: France, which is responsible for providing support in the areas of command, communications, administrative management and logistics to HQ COMFRMARFOR in accordance with the provisions of this Technical Arrangement. 1.5. “Participants “: France and all other contributing nations. 1.6. “Contributing nation”: each participant, excluding France, which, in its capacity as a NATO or EU member, accedes to this Technical Arrangement by signing a Note of Accession and provides personnel for HQ COMFRMARFOR, in accordance with the provisions of this Technical Arrangement. 1.7. “Command and Control (C2) Technical Arrangement”: the technical arrangement that defines the specific command and control elements of HQ COMFRMARFOR within the Atlantic Alliance framework, concluded between SHAPE and the Minister of Defence of the French Republic on 17 June 2005. Article II Purpose 2.1. The purpose of this Technical Arrangement (TA) is to provide for the status and participation of contributing nations` personnel in the activities of HQ COMFRMARFOR through the development of procedures for the manning, funding, management and support of the HQ. Article ΙΙΙ Missions of the HQ and conditions for its use 3.1. HQ COMFRMARFOR shall fulfil its missions in times of peace, crisis and during operations, in accordance with the C2 Technical Arrangement. 3.2. When so decided by the North Atlantic Council in accordance with current NATO procedures, HQ COMFRMARFOR may be deployed for an exercise or an operational mission decided by NATO. It may also be placed at the disposal of the European Union or committed to a national operation. HQ COMFRMARFOR should not be employed for a national or EU-mandated operation and thus become unavailable to NATO without prior notification to SACEUR. 3.3 All personnel assigned to HQ COMFRMARFOR may be deployed. However, a participant`s personnel shall not be deployed without its prior permission, which shall be sought through the relevant Senior national representative (SNR). Article IV Status of personnel and settlement of claims 4.1 The legal status of the personnel assigned to HQ COMFRMARFOR shall be governed by the NATO or PfP SOFA, as applicable. 4.2 The legal status of the personnel assigned to HQ COMFRMARFOR may also be governed by the EU SOFA, from the day on which it comes into force and as applicable. 4.3 Settlement of claims: 4.3.1 Claims (other than contractual ones) arising from or in connection with this Technical Arrangement and of the type covered by the NATO, PfP or EU SOFA, shall be settled in accordance with the provisions therein, as applicable 4.3.2. Representation in legal proceedings arising from official activities of HQ COMFRMARFOR or its personnel shall be provided by the framework nation on behalf of HQ COMFRMARFOR. Compensation and payments related to the official activities of HQ COMFRMARFOR or its personnel shall be shared among the participants as laid down in the NATO, PfP or EU SOFA as applicable. 4.4. Personnel assigned to HQ COMFRMARFOR may only take part in its activities if they have been issued with the required security clearances, in accordance with the security agreements between the contributing nations and the host nation. 4.5 The fiscal status of entitled personnel and their national support elements shall be governed by the letter from the Minister of Finance of the French Republic, dated 14in June 2005. Article V Manning 5.1. Manning of the Headquarters shall be based on the organization shown in Annex A to this Arrangement. 5.2. Any change by the framework nation in the approved multinational manning listed in Annex A concerning posts graded OF-3 and above, shall require 12 (twelve) months` advance notice given in writing to the contributing nations and SHAPE. 5.3. Any addition to or reduction in its contribution by a contributing nation regarding posts graded OF-3 and above, shall require 12 (twelve) months` advance notice given in writing to the framework nation which shall then notify the other contributing nations and SHAPE. 5.4. Changes in posts listed in Annex A regarding posts graded OF-2. and below that do not affect total manning or allocation to specific nations may be made under an informal written agreement between Commander HQ COMFRMARFOR and the relevant contributing nation. Commander HQ shall notify the other contributing nations and SHAPE. 5.5. Job descriptions and changes thereto must be agreed by the relevant contributing nations. HQ COMFRMARFOR personnel shall be employed ir accordance with the relevant job descriptions. Contributing nations shall provide personnel meeting the requirements of the relevant job descriptions. 5.6. Contributing nations shall provide HQ COMFRMARFOR with the personnel listed in Annex A in a timely manner so as to meet the specified readiness requirements. The rotation of personnel shall be the responsibility of the contributing nations. The assignment period shall be three years, unless otherwise agreed between the contributing nation and the host nation. Any replacement shall be notified at least two months before the end of the assignment. The contributing nation shalt have sole responsibility for advising the host nation thereof in due time. 5.7. All the personnel must meet the deployment requirements. In particular, contributing.nations shall guarantee their personnel`s medical qualification to be aboard ships for deployment. To ensure operational readiness and effectiveness, contributing nations may not withdraw their permanently assigned personnel from HQ COMFRMARFOR until appropriately trained replacement or additional personnel have been assigned, except in case of national emergency. In event of the unexpected departure of personnel because of force majeure, the sending nation shall refill the post as soon as possible. Article VI Discip and national duties 6.1. As regards discip and national duties, HQ COMFRMARFOR personnel shall be managed as laid down in ACO Directive 45-1. 6.2. Personnel assigned to HQ COMFRMARFOR shall be functionally subordinate to Commander HQ COMFRMARFOR, but shall remain subject to the disciplinary regulations of their sending nation. 6.3. in matters of discip and national duties, the SNRs or their representatives shall exercise, with regard to the personnel of their own nationality, all powers and competences conferred on them by their national laws and regulations. They shall ensure, within the limits laid down by their national laws and regulations, that their personnel comply with the instructions issued by Commander HQ COMFRMARFOR. Article VII Support services 7.1. The framework nation shall provide the support specified in Annex Β to this Technical Arrangement. The support provided by the framework nation may not be changed, reduced or terminated without prior notification to the contributing nations and SHAPE. 7.2. The conditions for the support of personnel assigned to HQ COMFRMARFOR are specified in the letter from the French Minister of Finance dated 14th June 2005. Article VIII Financial aspects 8.1. Under MC 317/1, the basic rule for headquarters and forces is that both are funded by the framework nation and/or by the contributing nations, 8.2. The framework nation shall bear the cost of operating and maintaining the deployable HQ COMFRMARFOR, with its equipment and infrastructure. 8.3. Expenditure outside the scope of the framework nation`s contribution or obligations shall be negotiated with the contributing nations and SHAPE. 8.4. The signatories` and the contributing nations` financial obligations shall be subject to the authorization and appropriation of funds in accordance with each nations` laws. 8.5. The criteria for eligibility for NATO funding or support for deployments by the Headquarters during operations approved by the North Atlantic Council are detailed in MC 317/1 and PO(2000)16. If eligible, financial support for given deployments and other expenditure shall be provided by SHAPE, following approval by the relevant budget committee. 8.6. Neither the framework nation nor the contributing nations shall derive revenue from the official activities of HQ COMFRMARFOR or its personnel. 8.7. Travel costs for personnel arriving at or leaving the Headquarters on initial appointment, leave and reassignment, shall be borne by the relevant contributing nation. 8.8. Notwithstanding any additional emoluments that may be paid by the contributing nations, the framework nation shall bear the cost of temporary duty trips made by personnel on behalf of the HQ in accordance with framework nation laws and regulations. 8.9. Subject to the approval of the framework nation, the contributing nations shall bear the cost of: a. Equipment or personnel brought into the HQ facilities in excess of that provided by the framework nation. b. Communications and information systems required to meet national requirements. c. The additional cost of any special facility or equipment required to meet national needs (including buildings, sports and recreational facilities), and of any contributing nations own operating costs where the framework nation can separately identify them. 8.10. The framework nation shall not be responsible for costs linked to the dependants of the contributing nations` personnel. 8.11. In times of peace, crisis and during operations, HQ COMFRMARFOR is also open to financial contributions from NATO or EU States, regardless of whether they have personnel included in this structure. Such contributions shall be sent to the framework nation which shall make them available to HQ COMFRMARFOR on the basis of an international agreement signed with the contributing state or organisation. Article IX Advisory Committee 9.1. When needed, the contributing nations` and signatories` representatives shall meet in an Advisory Committee under the chairmanship of the framework nation to discuss issues related to this arrangement as well as any other subjects concerning the HQ . SHAPE may delegate its authority to an appropriate NATO representative. Article X Financial management 10.1. Administrative and financial management shall be perfonned in accordance with the financial regulations and procedures in force within the framework nation. 10.2. When funds come from a NATO financial contribution, the administrative and financial management shall be earned out in accordance with NATO financial procedures. 10.3. When funds come from a NATO financial contribution, the relevant vouchers shall be sent to the appropriate strategic command, which shall designate the organisation responsible for the management audit (International Board of Auditors for NATO, ACO Audit and Inspection Branch at SHAPE or Joint Force Command (JFC) Internal Review organisation). These transactions shall be checked following NATO procedures. Article XI Equipment ajid infrastructure 11.1. HQ COMFRMARFOR equipment and infrastructure shall be provided as follows: 11.1.1. By the framework nation, free of charge. 11.1.2. NATO-funded property and equipment shall remain the property of NATO and may not be utilized for non-NATO operations, exercises or other purposes without the prior permission of the appropriate strategic command. 11.2. Equipment provided free of charge to HQ COMFRMARFOR by a contributing nation shall remain the latter`s property. Article XII Final provisions 12.1. Amendments. 12.1.1. Amendments of any article of this Technical Arrangement or of its Annex Β shall require the written approval of the signatories. 12.1.2. Changes to Annex A shall be made in accordance with the provisions of Article V of this Technical Arrangement. 12.2. Any dispute regarding the interpretation or implementation of this Technical Arrangement shall be settled by negotiation among the signatories and contributing nations. 12.3. Effective date. 12.3.1. This Technical Arrangement shall come into effect on the date of the last signature. 12.3.2. Each signatory shall have one original of this Technical Arrangement and a copy of any Note of Accession. Each contributing nation shall receive a certified copy of this arrangement from SHAPE. 12.3.3. Any third Parties, whether NATO or EU members, may accede to this Technical Arrangement by a Note of Accession written according to the model proposed in Annex C and agreed by the framework nation. The Mote of Accession shall come into force once it has been received by the framework nation. The latter shall forward this Note to SHAPE and the other contributing nations. 12.4. Termination of and withdrawal from this Technical Arrangement. 12.4.1. This Technical Arrangement may be terminated at any time by the unanimous consent of the signatories. Any contributing nation may withdraw from this Technical Arrangement by providing 12 months` advance notice in writing to both signatories The host nation shall advise the other contributing nations of any such event. 12.4.2. In the event of a withdrawal, the Advisory Committee shall meet to discuss amendments to the Establishment (Annex A) and other consequences. 12.4.3. The termination of this Technical Arrangement shall not relieve the signatories and contributing nations of their obligations resulting from its implementation. For SHAPE, the Supreme Allied Command Europe (SACEUR) ANNEX A HQ COMFRMARFOR ORGANIZATION AND MANNING TABLE DISTRIBUTION OF POSTS BY NATION “ΠΑΡΑΛΕΙΠΕΤΑΙΠΙΝΑΚΑΣ” ANNEX Β FRAMEWORK NATION SUPPORT Subject to the laws and regulations on its own territory and to availability, the framework nation guarantees logistic support and services under the terms of this annex : 1. Non-reimbursable support and services: 1.1. HQ SUPPORT 1.1.1 The Framework Nation shall provide the HQ with a deployable on-board command platform, and the appropriate facilities on shore. 1.1.2. In accordance with Articles VII and XI, the framework nation shall bear the cost of the following types of support and the associated expenditure: a) communication and information systems supporting HQ COMFRMARFOR in peacetime, as well as during deployments and operations; b) HQ COMFRMARFOR office furniture and computers (including maintenance, repair and replacement of office equipment); c) maintenance of and work on HQ COMFRMARFOR systems and infrastructure; d) vehicles used by the personnel on duty; e) fire prevention and protection, combat service support and equipment, in event of deployment; f) security, including guard personnel. 1.2. HQ PERSONNEL SUPPORT The framework nation shall provide contributing nations and the personnel with : a) the support and services specified in Article VII. b) assistance in finding suitable housing in the private sector, if the framework nation is unable to accommodate the personnel and their dependants, or when requested by the contributing nation; c) Assistance with education for school-age dependant children. 2. Reimbursable support and services: 2.1. Support to be reimbursed by contributing nations: Neither the framework nation, nor the other signatory or the contributing nations may derive revenue from the official activities of HQ COMFRMARFOR or from its international personnel. Reimbursement requests from the framework nation to contributing nations for support provided to their personnel serving in HQ COMFRMARFOR may only cover the cost actually borne by the framework nation. The framework nation shall provide the personnel of contributing nations and their employees with the services described below on a reimbursable basis: a) emergency medical services (if need be, repatriation to take place as prescribed in STANAG 2061); b) if the contributing nations so request, medical checks and the usual preliminary vaccinations prior to deployments or embarkation for personnel sent on temporary duty; 2.2. Reimbursable personnel support: Individual costs, fines and fees shall be paid by the person concerned. Support and services provided by the framework nation subject to reimbursement by the beneficiary include: a) catering: the contributing nations` personnel shall receive the same catering services as equivalent rank personnel of the framework nation, whether on shore, afloat or during deployments; b) Access by the contributing nations` personnel and the persons under their responsibility to recreational and welfare facilities (as well as associated activities), on the same basis as the framework nation`s personnel. c) Access to the officers` and non-commissioned officers` messes and clubs provided by the framework nation for its own personnel of equivalent rank. d) Access to housing: the contributing nation`s personnel shall pay the full rent and associated charges. 2.3. Invoicing: 2.3.1. Invoices and bills for services described in paragraphs 2.1 and 2.2 above shall be made out in Euros. 2.3.2. The framework nation shall ensure that invoices are issued promptly, ir accordance with the procedures agreed with each state party to this Technica Arrangement. Considerant le Traite de I`Union europeenne dans sa redaction resultant du Traite signe le 26 fevrier 2001 ; Considerant a Convention du 19 juin 1951 entre les parties au Traite de I`Atlantique Nord sur le statut de leurs forces (SOFA de I`OTAN), et a la Convention du 19 juin 1995 entre les Etats parties au Traite de i`Atlantique Nord et les autres Etats participant au Partenariat pour la paix sur le statut de leurs forces (SOFA du PPP); Consid£rant la Convention entre les Etats membres de I`Union europeenne sur le statut de leur personnel militaire et civil dStache aupres des institutions de I`Union europeenne, des quartiers generaux et forces mis a la disposition de I`Union europeenne et des quartiers generaux et forces pouvant dtre mis a sa disposition dans le cadre de la preparation et de Γ execution des taches mentionnees a I`Article 17 (2) du Traite sur I`Union europeenne, y compris pendant les exercices, et sur le statut du personnel militaire et civil des Etats membres mis a la disposition de I`Union europeenne pour agir dans ce cadre (SOFA de I`UE), signee a Bruxelles le 17 novembre 2003 ;

Considerant que, comme convenu dans le document MC 317/1 (definitif) approuve le 8 juillet 2002, le Conseil de I`Atlantique Nord a approuve la ” structure de forces de I`OTAN ” et decide que, lorsque les quartiers generaux concernes repondront a I`ensemble des criteres militaires approuves regissant les QG de forces a haut niveau de preparation/ forces a niveau de preparation moins eleve (HRF/FLR) tels que deflnis dans les documents IMSM-950-00 et IMSM-848- 00, ils seront, apres evaluation par les commandements strategiques, retenus et designes sous le nom de: COMMANDEMENT DE COMPOSANTE MARITIME DE DEPLOYMENT RAPIDE DE L`OTAN (NRDMCC)

Considerant que, conformement au document MC 317/1 (definitif) approuvo le 8 juillet 2002, le Comite militaire a decide que ces quartiers generaux deployables seraient finances sort dans un cadre national, sort dans un cadre multinational, Considerant la proposition de la France formulee par le Chef d`Etat-Major des Armees (CEMA) le 30 juin 2003, specifiee dans le memorandum n° 2875/RMF/CM/OTAN/M2/DRO du 1er octobre 2003 et acceptee par le Commandant supreme des Forces alliees en Europe (SACEUR) le 10 novembre 2003 par lettre portant la reference 3050/SHPXA/0510/03-99899 (incius dans le rectificatif 11 au document IMSM-580-00 du 20 novembre 03), Considerant 1`accord signe le 5 mai 2004 entre le SACEUR et le CEMA sur la planification et la condurte des operations, Considerant la proposition de ia France de mettre le quartier general du commandement de la composante maritime – France (QG COMFRMARFOR), implante a Toulon, en France, a la disposition de la structure de forces de I`ΟΤΑΝ, Affirmant que le tableau d`effectifs du QG COMFRMARFOR est confonme a la transformation de I`Alliance et a la participation de la France a la Force de reaction de ΙΌΤΑΝ (NRF), En reponse a la demande du Comrte militaire pour que des arrangements particuliers soient pris pour le commandement et le controle de chaque quartier general afin de determiner leur disponibilite en temps de paix et en temps de cnse ainsi que pendant la conduite d`operations, Reconnaissant le principe selon lequel !e quartier general est ouvert aux Etats agissant comme Etats membres de ΓΟΤΑΝ ou de I`Union europeenne Considerant qu`outre son engagement au service de i`ΟΤΑΝ, le QG COMFRMARFOR peut etre affecte a des missions Rationales ou de i`Unicn europeenne, Les Parties sont convenues des dispositions suivantes :

Article I

Definitions

Dans le present arrangement, les temnes suivants sont definis comme suit:

1.1 “QG COMFRMARFOR” : le quartier general militaire du COMFRMARFOR, dont la composition est decrite en detail dans I`annexe A.

1.2. “Signataires” : la nation cadre et le Grand Quartier general des Puissances alliees en Europe (SHAPE).

1.3 “Pays hote” : la Partie francaise, qui accueille sur son territoire souverain le QG COMFRMARFOR.

1.4. “Nation cadre” : la Partie frangaise, a qui ii incombe d`assurer le soutien du COMFRMARFOR dans les domaines du commandement, des telecommunications, de la gestion administrative et de la logistique, en appliquant les dispositions du present Arrangement technique.

1.5. “Participants” : la Partie frangaise et tous les Etats contributeurs.

1.6. “Etats contributeurs” : les participants, a exclusion de la partie frangaise, qui, agissant en tant que membres de ΓΟΤΑΝ ou de I`Union europeenne, adherent au present arrangement technique en signant une notification d`adhesion et participent a la dotation en effectif du QG COMFRMARFOR conformement aux dispositions du present arrangement technique.

1.7. “Arrangement technique concemant le commandement et le controle (C2)” : [`arrangement technique qui deftnit les elements precis de commandement et de controle du QG COMFRMARFOR dans le cadre de I`Alliance atlantique, conclu entre le SHAPE et le ministre de la defense de la Republique francaise le 17 juin 2005.

Article II

Objet

2.1. Le present arrangement technique a pour objet d`etablir des dispositions concernant le statut et la participation du personnel des Etats contributeurs participant aux activites du QG COMFRMARFOR, par I`etablissement de procedures pour la dotation en effectif, le financement, ia gestion et le soutien du QG.

Article III

Missions et conditions d`utllisatlon du quartier general

3.1. Le QG COMFRMARFOR remplit ses missions en temps de paix, en periode de crise et dans le cadre d`operations conformement aux dispositions de I`arrangement technique concernant le commandement et le controle.

3.2. Sur decision du Conseil de i`Atlantique Nord et conformement aux procedures en vigueur a ΓΟΤΑΝ, le QG COMFRMARFOR peut etre deploye pour un exercice OL une mission operationnelle decide par ΓΟΤΑΝ. II peut egalennent etre mis a ia disposition de I`Union europeenne ou engage dans le cadre d`une operation nationaie. Le QG COMFRMARFOR ne peut pas etre employe dans le cadre d`une operation nationaie ou mandate par I`Union europeenne et de ce fait ne plus etre a la disposition de ΓΟΤΑΝ sans que le SACEUR n`en sort formellement averti at prealable.

3.3. Tout le personnef affecte au QG COMFRMARFOR est susceptible de participer a un deploiement. Toutefois, le personnel d`un participant ne doit pas etre deploye sans I`autorisation prealable de celui-ci, qui est demandee par I`intermediaire du representant national principal (SNR) competent.

Article IV

Statut du personnel et reglement des demandes d`indemnisation

4.1 Le statut juridique du personnel affecte au QG COMFRMARFOR est regi, seior le cas. oar le SOFA de ΙΌΤΑΝ ou du PPP.

4.2. Le statui juridique du personnel affecie au QG COMFRMARFOR peut egalement etre regi par le SOFA de I`UE, a partir du jour ou celui-ci entre en vigueur et lorsqu`il est applicable.

4.3. Reglement des dommages :

4.3.1. Les demandes d`indemnisation (autres que celles resultant de I`applicatlon d`un contrat) decoulant du present arrangement technique ou en rapport avec celui-ci et relevant de la categorie visee par le SOFA de I`OTAN, du PPP ou de I`UE, sont traitees conformement aux dispositions de ces conventions, suivant le cas.

4.3.2. La representation dans le cadre d`actions en justice decoulant d`activites officielles du QG COMFRMARFOR ou de son personnel est assures par la Nation cadre au nom du QG COMFRMARFOR. Les indemnitee et paiements imputables a des activites officielles du QG COMFRMARFOR ou de son personnel sont roparties entre les participants conformement aux dispositions du SOFA de I`OTAN, du PPP ou de I`UE, suivant le cas.

4.4. La participation du personnel affecte au QG COMFRMARFOR aux activites de celui-ci n`est possible que si les habitations de securite requises ont ete delivrees, ………. aux accords en matiere de securite conclus entre les Etats contributeurs et le pays note.

4.5. Le statut fiscal du personnel ayant droit et de ses elements de soutien nationaux est regi par les dispositions de la lettre du 14 juin 2005 du ministre des finances de la Republique frangaise. Article V Dotation en personnel

5.1. La dotation en personnel du quartier general est base sur la structure organisationnelle qui figure en annexe A au present arrangement.

5.2. Les modifications apportees par la nation cadre a I`effectif multinational approuve (voir I`annexe A) touchant des postes de grade superieur ou egal a OF-3 requierent un preavis ecrit de 12 (douze) mois a transmettre aux Etats contributeurs …………..

5.3. Toute modification, en plus ou en moins, apportee par un Etat contributeur a sa contribution en ce qui conceme des postes de grade superieur ou egal a OF-3, necessite un preavis ecrit de 12 (douze) mois a envoyer a la Nation cadre, qui en avisera les autres Etats contributeurs ainsi que le SHAPE.

5.4. Les modifications concernant des postes definis dans I`annexe A de grade inferieur ou egal a QF-2 qui n`affectent ni le niveau des effectifs ni leur attribution a des Etats donnes peuvent s`effectuer par un arrangement informel ecrit entre le commandant du QG COMFRMARFOR et tout Etat contributeur conceme, a charge pour le commandant du QG d`en informer les autres Etats contributeurs et le SHAPE.

5.5. Les descriptions de poste ainsi que les modifications apportees a celles-ci necessitent I`aval des Etats contributeurs concernes. Le personnel du QG COMFRMARFOR est employe conformement aux descriptions de poste applicables. Les Etats contributeurs foumiront du personnel conformement aux descriptions de poste appropriees.

5.6. Les Etats contributeurs foumiront le personnel specifie dans I`annexe A au QG COMFRMARFOR en temps voulu afin que celui-ci respecte les imperatifs en matiere d`etat de preparation. La rotation du personnel releve de la competence des Etats contributeurs. Sauf accord contraire entre I`Etat contributeur et le pays note, la periode d`affectation est de trois ans. Tout remplacement doit etre annonce deux mois au moins avant la fin de I`affectation. Seul I`Etat contributeur est competent pour en informer ie pays hote en temps voulu.

5.7. Tout le personnel doit repondre aux exigences en matiere de deploiement. Tout particulierement, les Etats contributeurs doivent garantir que ie personnel sera medicalement apte a se deployer a bord des navires. Pour garantir I`efficacite et I`etat de preparation operationnelte du QG, les Etats contributeurs ne doivent pas retirer leur personnel affecte au QG COMFRMARFOR de fagon permanente tant que du personnel de remplacement ou supplemental convenablement forme n`a pas ete designe, sauf en cas d`urgence nationale. En cas de depart imprevu d`un membre du personnel pour raison de force majeure, I`Etat d`envoi est tenu de pourvoir le poste dcvenu vacant dans ies plus brefs delsis. Article VI Discip et obligations nationales

6.1. En ce qui concerne fa discip et les obligations nationales, la gestion du personnel du quartier general doit suivre les procedures specifiees dans la Directive 45-1 du Commandement allie Operations (ACO).

6.2. Sur le plan fonctionnel, le personnel affecte au QG COMFRMARFOR releve du commandant du QG, mais, sur le plan disciplinaire, il reste soumis aux reglements du participant dont il est ressortissant.

6.3. S`agissant des questions liees a la discip et aux obligations nationales, les SNR ou leurs delegues sont investis, vis-a-vis du personnel de leur Etat d`envoi, de tous les pouvoirs et competences que leur conferent les lois et reglements nationaux. lis doivent veiller a ce que leur personnel se conforme aux instructions du commandant du QG COMFRMARFOR, dans les limites prescrites par leurs propres lois et reglements nationaux.

Article VII

Services de soutien

7.1. La nation cadre assure le soutien decrit dans I`annexe Β au present arrangement technique. Le soutien assure par la nation cadre ne peut etre modifie, reduit ou suspendu sans que les Etats contributeurs et le SHAPE n`en aient ete prealablement informes.

7.2. Les conditions du soutien assure au personnel affecte au QG COMFRMARFOR sont precisees dans la lettre du ministre des Finances francais du 14 jutn 2005. Article VIII Aspects financiers

8.1. En vertu des dispositions du MC-317/1, la regie de base prevoit que le financement du quartier general et des forces est assure par la nation cadre et/ou par les Etats contributeurs.

8.2. La nation cadre prend a sa charge les frais d`exploitation et de maintenance du QG COMFRMARFOR deployable ainsi que de son materiel et de ses infrastructures.

8.3. Les charges financieres sortant du cadre de la contribution ou des obligations du Nation cadre sont a negocier avec les Etats contributeurs et le SHAPE.

8.4. Les obligations financieres des signataires et des Etats contributeurs sont soumises aux autorisations et allocations budgetaires prevues par les differentes legislations nationales.

8.5. Les criteres d`eligibilite au financement de ΓΟΤΑΝ ou du soutien des depioiements par le quartier general pendant ia conduite d`operations approuvees par le Conseil de I`Atlantique Nord sont decrits en detail dans les documents MC-317/1 et PO(2000)16. En cas d`eligibilite, le soutien financier a des depioiements donnes ou a d`autres depenses est assure par le SHAPE, apres approbation du comite financier competent.

8.6. Ni la nation cadre ni les Etats contributeurs ne doivent tirer cie revenus des activites officielles du QG COMFRMARFOR ou de son personnel.

8.7. Les frais de deplacement du personnel se rendant au quartier general ou quittant celui-ci dans le cadre d`une affectation initiale ou d`une reaffectation ou a I`occasion de conges sont a charge de I`Etat contributes conceme 8.8. Independamment des omoiuments supplementaires eventuellement verses par les Etats contributeurs, la nation cadre prend a sa charge ies frais de deplacements en mission effectues par le personnel pour le compte du QG, comformement aux lois et reglements de la nation cadre. 8.9. Sous reserve d`approbation par la nation cadre, les Etats contributeurs prennent a leur charge les depenses suivantes :

a. Le cout du materiel ou du personnel introduit dans le QG en sus du materiel et du personnel foumis par la nation cadre.

b. Le cout des systemes d`information et de communication resultant de besoins nationaux.

c. Le cout supplementaire lie aux installations ou materiels speciaux eventuellement necessaires pour repondre a des besoins nationaux (y cornpris ies batiments et les installations sportives et recreatives), sinsl que ies depenses de fonctionnemsnx propres a un Etat contributeur et qui peuvent lui etre imputees distinctement par la nauori caure.

8.10. La nation cadre ne peut etre tenue responsable des depenses concemant les personnes a charge du personnel des Etats contributeurs.

8.11. En temps de paix, en periode de crise ou pendant des operations, le QG COMFRMARFOR est egalement ouvert a la contribution financiere des Etats membres de ΓΟΤΑΝ ou de I`Union europeenne, independamment du fait que du personnel de ces Etats soit ou non integro dans cette structure. Ces contributions sont envoyees a la nation cadre, qui les met a la disposition du QG COMFRMARFOR, sur le fondement d`un engagement international conclu avec I`Etat ou I`organisation apportant ladite contribution.

Article IX

Comite consultatlf

9.1. Si besoin est, les representants des Etats contributeurs et des signatatres se reunissent au sein d`un comite consultatif, sous la pr£sidence de la nation cadre, pour y discuter des questions relatives au present arrangement ainsi que d`autres sujets concemant I`etat-major. Le SHAPE peut deleguer son autorite a un representant qualifie de ΓΟΤΑΝ.

Article X

Gestion financiere

10.1. La gestion administrative et financiere s`effectue conformement aux procedures et reglements financiers en vigueur sur le territoire de la nation cadre.

10.2. Dans 1e cas de credits provenant d`une contribution financiere de ΓΟΤΑΝ, la gestion administrative et financiere s`effectue suivant tes procedures financieres applicables de ΓΟΤΑΝ.

10.3. Dans le cas de credits provenant d`une contribution financiere de ΓΟΤΑΝ, les pieces justificatives de la transaction sont transmises au commandement strategique competent, qui designe lOrganisme responsabie du coniroie de la gestion (Coiiege international des commissaires aux comptes de ΓΟΤΑΝ, Service de la Verification ccrr.ptable et de I`lnspection du SHAPE ou organisme de controls interne du Commandement des Forces alliees interarmees (UFC)). Ces transactions font I`objet d`une verification suivant les procedures en vigueur a I`ΟΤΑΝ.

Article XI

Materiels et infrastructures

11.1. Les materiels et infrastructures du QG COMFRMARFOR sont fournis selon ies modalites suivantes:

11.1.1. Par la nation cadre, a titre gratuit.

11.1.2. Les biens et materiels finances par ΓΟΤΑΝ restent sa propriete et ne doivent pas §tre utilises a des fins autres que celles propres a ΓΟΤΑΝ(operations, exercices ou autres activites) sans que le commandement strategique competent ne I`ait autorise au prealable.

11.2. Le materiel foumi gratuitement au QG COMFRMARFOR par un Etat contributeur reste la propriete de celui-ci. Article XII Dispositions finales

12.1. Amendements

12.1.1. Tout amendement ou modification d`un des articles du present arrangement technique ou de son annexe Β requiert (`approbation ecrite des signataires.

12.1.2. Les modifications de I`annexe A sont apportees conformement aux dispositions de I`article V du present arrangement technique.

12.2. Tout differend concernant [`interpretation ou I`application du presen: arrangement technique est regie par voie de negociation entre les signataires et les Etats contributeurs.

12.3. Entree en vigueur

12.3.1. Le pr£sent arrangement technique entre en vigueur a la date de sa derniere signature.

12.3.2. Chaque signataire detient un exemplaire original du present arrangement technique ainsi qu`une copie de toute notification d`adhesion. Chaque Etat contributeur recoitdu SHAPE une copie certifiee conforme de I`arrangement.

12.3.3. Des Etats tiers, membres de ΓΟΤΑΝ ou de I`Union europeenne, peuvent adherer au present arrangement technique par le biais d`une notification d`adhesion redigee suivant le modele propose en annexe C, celle-ci devant §tre approuvee par la nation cadre. La notification d`adhesion entre en vigueur des sa reception par la nation cadre. La nation cadre assure la transmission de cette notification d`adhesion au SHAPE et aux autres Etats contributeurs.

12.4. Fin et retrait de cet arrangement technique

12.4.1. Le present arrangement technique peut prendre fin a tout moment par accord unanime des signataires. Tout Etat contributeur peut se retirer du present arrangement technique moyennant un preavis ecrit de 12 mois a signifier a tous les signataires. Le pays hote est tenu d`informer les autres Etats contributeurs d`une telle decision.

12.4.2. En cas de retrait, le comite consultatif se reunrt pour examiner les modifications a apporter au tableau d`effectifs (annexe A) ainsi que les autres consequences eventuelles de cette decision.

12.4.3. La fin de rarranqement technique ne libere pas les signataires et les Etats contributeurs des obligations decoulant de son execution. TABLEAU D`EFFECTIFS ET DE DOTATION DU QG REPARTITION DES POSTES ENTRE LES PAYS “ΠΑΡΑΛΕΙΠΕΤΑΙΠΙΝΑΚΑΣ” ANNEXE Β SOUTIEN FOURNI PAR LA NATION CADRE Sous reserve des lois et reglements en vigueur sur le territoire national ainsi que des disponibilites, la nation cadre garantit le soutien et les services logistiques, conformement aux dispositions de la presente annexe.

1. Soutien et services ne donnant pas lieu a un remboursement:

1.1. SOUTIEN DUQG

1.1.1. La nation cadre met a disposition le QG, dote d`une plate-forme deployable de commandement embarque, ainsi que les installations necessaires a terre.

1.1.2. Conformement aux dispositions des articles VII et XI, la nation cadre prend en charge les formes de soutien suivantes ainsi que les depenses qui en decoulent:

a) systemes d`information et de communication assurarrt le soutien de la structure du QG COMFRMARFOR en temps de paix ainsi que pendant les d£ploiements et operations;

b) foumiture de mobilier et d`ordinateurs pour les bureaux du QG COMFRMARFOR (y compris maintenance, reparation et remplacement du materiel de bureau) ;

c) maintenance et travaux a realtser sur les systemes et infrastructures du QG COMFRMARFOR;

d) vehicules utilises par le personnel dans I`exercice de ses functions ;

e) prevention et protection contre I`incendie, et materiel et soutien logistique du combat en cas de deploiement;

f) securite, y compris personnel de surveillance. 1.2. SOUTIEN DU PERSONNEL DU QG La nation cadre foumit aux Etats contributeurs et au personnel le soutien suivant:

a) les formes de soutien et les services specifies a Particle VII ;

b) une aide dans la recherche de logements convenables dans le secteur prive, si la nation cadre n`est pas en mesure de loger le personnel et les personnes a sa charge ou lorsque I`Etat contributeur le demande ;

c) assistance sur le plan de i`education des enfants a charge en age scolaire.

2. Soutien et services donnant lieu a un remboursement:

2.1. Soutien moyennant remboursement a charge des Etats contributeurs : Ni la nation cadre ni les autres signataires ne doivent tirer de revenus des activites officielles du QG COMFRMARFOR ou de son personnel a statut international. Les demandes de remboursement adressees par la nation cadre aux Etats contributeurs pour le soutien qu`il assure a leur personnel affecte au QG COMFRMARFOR ne peuvent porter que sur les couts effectivement encourus par la nation cadre. La nation cadre assure, contre remboursement, les services decrits ci-dessous au personnel des Etats contributeurs et aux personnes que ceux-ci emploient:

a) services medicaux d`urgence (au besoin rapatriement conformement aux dispositions du STANAG 2061);

b) si les £tats contributeurs le demandent, visites medicales et vaccinations preliminaires normales du personnel envoye en mission, prealablement a un deploiement ou a un embarquement.

2.2. Soutien du personnel donnant lieu a un remboursement: Les frais individuels, amendes et redevances sont a payer par I`utiiisateur. Le soutien et les services assures au personnel par la nation cadre moyennant remboursement par le beneficiaire comprennent:

a) restauration : le personnel des Etats contributeurs beneficie des memes conditions de restauration que celui de la nation cadre, a grade egal, tant a terre qu`a bord ou pendant les deploiements ;

b) le personnel des Etats contributeurs, de meme que les personnel sous leur responsabilite, ont acces aux installations socio-recreatives ainsi qu`aux activites connexes dans les memes conditions que celles; dont jouit le personnel de la Nation cadre;

c) acces aux mess et cercles militaires des officiers et sous-officiers mis par la nation cadre a la disposition de son personnel de grade correspondant;

d) logement: le personnel des differents Etats contributeurs est tenu de payer le montant integral du loyer ainsi que les charges connexes.

2.3. Facturation : 2.3.1. Les factures et notes emises pour les services decrits aux paragraphes 2.1 et 2.2 ci-dessus sont libellees en euros.

2.3.2. La nation cadre veille a ce que les factures soient etablies sans delai, conformement aux modalites convenues avec chacun des Etats parties au present arrangement technique.

Άρθρο 1
Ορισμοί

Στην παρούσα συμφωνία, οι ακόλουθοι όροι έχουν της εξής σημασία :

1.1 “HQ COMFRMARFOR” : Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), η σύνθεση του οποίου περιγράφεται στο παράρτημα Α.

1.2 “Υπογράφοντες” : το έθνος – πλαίσιο και η Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE).

1.3 “Κράτος Υποδοχής” : η Γαλλία, η οποία υποδέχεται επί του κυρίαρχου εδάφους της το Στρατηγείο Διοικήσεοος της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR)

1.4 “Εθνος – πλαίσιο” : η Γαλλία, στην οποία έγκειται να διασφαλίζει την υποστήριξη του COMFRMARFOR στους τομείς της διοικήσεοος, των τηλεπικοινωνιών, της διοικητικής διαχειρίσεως και της εφοδιαστικής (iogistique), εφαρυόζοντας τις διατάξεις της παρούσας Τεχνικής Διευθετήσεως.

1.5 “Συμμετέχοντες” : η Γαλλία και όλα τα συμβάλλοντα Κράτη.

1.6 “Συμβάλλοντα Κράτη” : οι συμμετέχοντες, πλην της Γαλλία:, οι οποίοι, ενεργώντας ως μέλη του NATO ή της Ευρωπαϊκής Ενώσεως, προσχωρούν στην παρούσα Τεχνική Διευθέτηση, υπογράφοντας κοινοποίηση προσχοφησεως, και οι οποίοι συμμετέχουν στην Επάνδρωση του Στρατηγείου Διοικήσεις της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), σύμφωνα με τις διατάξεις της παρούσης Τεχνικής Διευθετήσεως.

1.7 “Τεχνική Διευθέτηση περί διοικήσεως και ελέγχου (C2)” : η τεχνική διευθέτηση με την οποία καθορίζονται τα ακριβή στοιχεία διοικήσεως και ελέγχου του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) στο πλαίσιο της Ατλαντικής Συμμαχίας, και η οποία υπεγράφη μεταξύ της Ανώτατης Διοίκησης Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) και του Υτουργού Εθνικής Αμύνης της Γαλλικής Δημοκρατίας, στις 17 Ιουνίου 2005.
Άρθρο 2
Σκοπός

2.1 Σκοπός της παρούσης διευθετήσεως είναι η θέσπιση διατάξεων οι οποίες αφορούν το καθεστώς και τη συμμετοχή του προσωπικού των συνεισφερόντων Κρατών τα οποία συμμετέχουν στις δραστηριότητες του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), με την καθιέρωση διαδικασιών για την Επάνδρωση, τη Χρηματοδότηση, τη διαχείριση και την υποστήριξη του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR).
Άρθρο 3
Αποστολές και προϋποθέσεις χρησιμοποιήσεως του Αρχηγείου

3.1 Το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) εκτελεί τις αποστολές του σε περίοδο ειρήνης, σε περίοδο κρίσεως και στο πλαίσιο επιχειρήσεων σύμφωνα με τις διατάξεις της τεχνικής διευθετήσεως η οποία αφορά τη διοίκηση και τον έλεγχο.

3.2 Κατόπιν αποφάσεως του Βορειοατλαντικού Συμβουλίου και σύμφωνα με τις ισχύουσες στο πλαίσιο του NATO διαδικασίες, το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARPOR) δύναται να αναπτύσσεται για άσκηση ή επιχειρησιακή αποστολή που αποφασίζει το NATO. Δύναται, επίσης, να τίθεται στη διάθεση της Ευρωπαϊκής Ενώσεως ή να επιχειρεί στο πλαίσιο εθνικής επιχειρήσεως. Το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) δεν δύναται να χρησιμοποιείται στο πλαίσιο εθνικής επιχειρήσεως ή επιχειρήσεως την οποία ζητά η Ευρωπαϊκή Ενωση και, ως εκ τούτου, να μην είναι πλέον στη διάθεση του NATO, χωρίς να έχει προηγουμένως ρητώς ειδοποιηθεί ο Ανώτατος Συμμαχικός Διοικητής Ευρώπης (SACEUR).

3.3 Δύναται να συμμετέχει σε ανάπτυξη το σύνολο του τοποθετημένου προσωπικού στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COiVIFRIViARFOR). Εν τούτοις, το προσωπικό συμμετέχοντος, δεν πρέπει να αναπτύσσεται άνευ προηγουμένης αδείας αυτού, η οποία ζητείται δια του αρμοδίου επικεφαλής εθνικού εκπροσώπου (SNR).
Άρθρο 4
Καθεστώς του προσωπικού καν ρυθμίσεις περί αιτημάτων αποζημιώσεως

4.1 Το νομικό καθεστώς του τοποθετημένου στο Στρατηγείο Διοικήσεοος της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) προσωπικού διέπεται, ανάλογα με την περίπτωση, από τη SOFA του NATO ή του PfP,

4.2 Το νομικό καθεστώς του τοποθετημένου στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) προσωπικού δύναται, επίσης, να διέπεται από τη SOFA της Ευρωπαϊκής Ενώσεως, από της ημερομηνίας κατά την οποία τίθεται σε ισχύ και όταν έχει εφαρμογή.

4.3 Διακανονισμός ζημιών :

4.3.1 Ο χειρισμός των περί αποζημιώσεως αιτημάτων (πλην εκείνων τα οποία συνεπάγεται η εφαρμογή συμβάσεως) τα οποία απορρέουν από την παρούσα τεχνική διευθέτηση ή σε σχέση με αυτή και υπάγονται στην κατηγορία SOFA του NATO, PfP ή ΕΕ, είναι σύμφωνος προς τις διατάξεις αυτών των διεθνών συμβάσεων, αναλόγως της περιπτώσεως.

4.3.2 Η εκπροσώπηση στο πλαίσιο της ασκήσεως ενδίκων μέσων που απορρέουν απο επίσημες δραστηριότητες του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) ή του προσωπικού αυτού, εξασφαλίζεται από το Εθνος – πλαίσιο εν ονόματι του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR). Οι αποζημιώσεις και πληρωμές λόγω των επισήμων δραστηριοτήτων του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) ή του προσωπικού αυτού, κατανέμονται στους συμμετέχοντες σύμφωνα με τις διατάξεις των SOFA του NATO, ΡfΡ ή ΕΕ αναλόγως της περιπτώσεως.

4.4 Η συμμετοχή του τοποθετημένου στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) προσωπικού στις δραστηριότητας αυτού είναι δυνατή μόνον εάν έχουν χορηγηθεί οι απαιτούμενες διαπιστεύσεις ασφαλείας, σύμφωνα με τις συμφωνίες σε θέματα ασφαλείας, οι οποίες έχουν συναφθεί μεταξύ των Συμβαλλόντων Κρατών και της φιλοξενούσας χώρας.

4.5 Το φορολογικό καθεστώς των δικαιούχων μελών του προσωπικού καθώς και του εθνικού βοηθητικού προσωπικού διέπεται από τις διατάξεις της από 14 Ιουνίου 2005 επιστολής του Υπουργού Οικονομικών της Γαλλικής Δημοκρατίας.
Άρθρο 5
Επάνδρωση

5.1 Η Επάνδρωση του Αρχηγείου βασίζεται στο οργανόγραμμα του Παραρτήματος Α στην παρούσα διευθέτηση.

5.3 Κάθε τροποποίηση, κατά το μάλλον ή ήττον, την οποία επιφέρει Συμβάλλον Κράτος στη συνεισφορά του όσον αφορά τις υψηλές θέσεις ή θέσεις αντιστοιχούσες σε βαθμό μεγαλύτερο ή ίσο του Πλωτάρχη (OF-3), πραγματοποιείται κατόπιν εγγράφου προειδοποιήσεως, η οποία λαμβάνει χώρα 12 (δώδεκα) μήνες πριν και πρέπει να απευθύνεται προς το Εθνος – πλαισιο, το οποίο θα ενημερώσει σχετικά τα λοιπά Συμβάλλοντα Κράτη, ως και την Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE).

5.4 Οι μεταβολές οι οποίες αφορούν τις θέσεις του Παραρτήματος Α, αντιστοιχούν σε βαθμό κατώτερο ή ίσο του Υποπλοιάρχου (OF-2) και δεν επηρεάζουν το επίπεδο του προσωπικού ούτε τη συμβολή τους σε συγκεκριμένα Κράτη, δύνανται να λαμβάνουν χώρα κατόπιν εγγράφου ανεπισήμου διευθετήσεως μεταξύ του Διοικητού του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) και κάθε ενδιαφερομένου Συμβάλλοντος Κράτους, ο δε Διοικητής του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) οφείλει να ενημερώνει σχετικά τα λοιπά Συμβάλλοντα Κράτη και την Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE).

5.5 Οι περιγραφές θέσεως καθώς και οι επιφερόμενες σε αυτές μεταβολές απαιτούν την προηγούμενη έγκριση των ενδιαφερομένων Συμβαλλόντων Κρατών. Το προσωπικό του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) προσλαμβάνεται σύμφωνα με τις εφαρμοστέες περιγραφές θέσεως. Τα Συμβάλλοντα Κράτη θα παρέχουν το προσωπικό σύμφωνα με τις κατάλληλες περιγραφές θέσεως.

5.6 Τα Συμβάλλοντα Κράτη θα παρέχουν το προσωπικό του Παραρτήματος Α στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) κατά τον επιθυμητό χρόνο, ώστε το Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) να ανταποκρίνεται στις απαιτήσεις σε θέματα προπαρασκευής. Η εναλλαγή του προσωπικού εμπίπτει στο πεδίο αρμοδιότητας των Συμβαλλόντων Κρατών. Πλην αντιθέτου συμφωνίας μεταξύ του Συμβάλλοντος Κράτους και της φιλοξενούσας χώρας, το προσωπικό τοποθετείται για τρία έτη. Κάθε αντικατάσταση πρέπει να ανακοινώνεται τουλάχιστον δύο μήνες πριν από τη λήξη της ως άνω τριετούς περιόδου. Μόνο αρμόδιο να ενημερώνει σχετικά τη φιλοξενούσα χώρα, σε εύθετο χρόνο, είναι το Συμβάλλων Κράτος.

5.7 Ολα τα μέλη του προσωπικού πρέπει να ανταποκρίνονται στις απαιτήσεις της αναπτύξεως. Ειδικότερα, τα Συμβάλλοντα Κράτη πρέπει να εγγυώνται ότι τα μέλη του προσωπικού θα είναι ιατρικώς ικανά να αναπτύσσονται επί των πλοίων. Προς εξασφάλιση της αποτελεσματικότητας και της επιχειρησιακής προπαρασκευής του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), τα Συμβάλλοντα Κράτη δεν πρέπει να ανακαλούν το προσωπικό το οποίο έχουν τοποθετήσει στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) σε μόνιμη βάση ενόσω δεν έχει τοποθετηθεί άλλο προσωπικό προς αντικατάσταση ή επιπλέον προσωπικό, εκτός εάν πρόκειται για περίπτωση εθνικής έκτακτης ανάγκης. Σε περίπτωση εκτάκτου αναχωρήσεως μέλους του προσωπικού για λόγους ανωτέρας βίας, το Κράτος αποστολής υποχρεούται να καλύψει την κενή θέση το συντομότερο.
Άρθρο 6
Κανονισμοί και εθνικές υποχρεώσεις

6.1 Οσον αφορά την πειθαρχία και τις εθνικές υποχρεώσεις, η διοίκηση του προσωπικού του Αρχηγείου πρέπει να ακολουθεί τις διαδικασίες οι οποίας ορίζονται στην Οδηγία 45-1 (ACO Directive 45-1) της Συμμαχικής Διοικήσεως Επιχειρήσεων (ACO).

6.2 Σε επίπεδο λειτουργίας, το προσωπικό το οποίο τοποθετείται στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRM ARFOR) υπάγεται στον Διοικητή του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRM ARPOR), αλλά σε πειθαρχικό επίπεδο, εξακολουθεί να υπάγεται στους κανονισμούς του συμμετέχοντος, του οποίου τυγχάνει υπήκοος.

6.3 Προκειμένου περί θεμάτων συνδεομένων με την πειθαρχία και τις εθνικές υποχρεώσεις, οι SNR ή οι πληρεξούσιοι αυτών διαθέτουν, έναντι του προσωπικού του Κράτους αποστολής τους, όλες τις εξουσίες και αρμοδιότητες τις οποίες οι εθνικοί νόμοι και κανονισμοί επιφυλάσσουν σε αυτές. Πρέπει, επίσης, να μεριμνούν ώστε το προσωπικό τους να συμμορφώνεται προς τις διαταγές του Διοικητού του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ CO`VIFRAiARFOR), εντός των ορίων που τάσσουν οι εθνικοί νόμοι και κανονισμοί τους.
Άρθρο 7
Υπηρεσίες υποστηρίξεως

7.1 Το Εθνος – πλαίσιο εξασφαλίζει την υποστήριξη η οποία περιγράφεται στο Παράρτημα Β της παρούσης τεχνικής διευθετήσεως. Η υποστήριξη η οποία εξασφαλίζεται από το Εθνος – πλαίσιο δεν δύναται να αποτελεί αντικείμενο μεταβολής, μειώσεως ή αναστολής εάν τα Συμβάλλοντα Κράτη και η Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) δεν έχουν προηγουμένως ενημερωθεί σχετικά.

7.2 Οι προϋποθέσεις και οι συνθήκες της υποστηρίξεως η οποία εξασφαλίζεται στο προσωπικό το οποίο έχει τοποθετηθεί στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), αναφέρονται λεπτομερώς στην από 14 Ιουνίου 2005 επιστολή του Γάλλου Υπουργού Οικονομικών.
Άρθρο 8
Χρηματοδότηση

8.1 Δυνάμει των διατάξεων MC-317/1, ο βασικός κανόνας προβλέπει ότι η Χρηματοδότηση του Στρατηγείου και των δυνάμεων εξασφαλίζεται από το Εθνος – πλαίσιο και / ή από τα Συμβάλλοντα Κράτη

8.2 Το Εθνος – πλαίσιο αναλαμβάνει τις δαπάνες εκμεταλλεύσεως και συντηρήσεως του δυνάμενου να αναπτυχθεί Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), καθώς και του υλικοτεχνικού εξοπλισμού και των υποδομών αυτού.

8.3 Τα οικονομικά βάρη στο πλαίσιο της συνεισφοράς ή των υποχρεώσεων του Εθνους – πλαισίου, αποτελούν αντικείμενο διαπραγματεύσεων με τα Συμβάλλοντα Κράτη και την Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE).

8.4 Οι οικονομικές υποχρεώσεις των υπογραφόντων και των Συμβαλλόντων Κρατών υπόκεινται στις εγκρίσεις και οικονομικές ενισχύσεις του προϋπολογισμού οι οποίες προβλέπονται από τις διάφορες εθνικές νομοθεσίες.

8.5 Τα κριτήρια επιλεξιμότητας στη Χρηματοδότηση του NATO ή της υποστηρίξεως των αναπτύξεων από το Στρατηγείο κατά τη διενέργεια επιχειρήσεων οι οποίες έχουν την έγκριση του Βορειοατλαντικού Συμβουλίου, περιγράφονται λεπτομερώς στα έγγραφα MC-317/1 και ΡΟ(2000)16. Σε περίπτωση επιλεξιμότητας, η οικονομική υποστήριξη σε συγκεκριμένες αναπτύξεις ή σε άλλες δαπάνες εξασφαλίζεται από την Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE), κατόπιν εγκρίσεως της αρμοδίας Επιτροπής Οικονομικών.

8.6 Ούτε το Εθνος – πλαίσιο ούτε τα Συμβάλλοντα Κράτη δύνανται να προσπορίζονται οφέλη από τις επίσημες δραστηριότητες του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) ή από το προσωπικού αυτού

8.7 Τα έξοδα μετακινήσεως του προσωπικού προς και από το Στρατηγείο στο πλαίσιο της αρχικής τοποθετήσεως ή επανατοποθετήσεως ή αδείας, βαρύνουν το ενδιαφερόμενο Συμβάλλον Κράτος.

8.8 Ανεξαρτήτως των επιπλέον αποδοχών οι οποίες ενδεχομένως καταβάλλονται από τα Συμβάλλοντα Κράτη, το Εθνος – πλαίσιο αναλαμβάνει τα έξοδα μετακινήσεως στο πλαίσιο αποστολών, τα οποία πραγματοποιεί το προσωπικό για λογαριασμό του Στρατηγείου, σύμφωνα με τους νόμους και κανονισμούς του Εθνους – πλαισίου.

8.9 Με την επιφύλαξη της εγκρίσεως από το Εθνος – πλαίσιο, τα Συμβάλλοντα Κράτη αναλαμβάνουν τις ακόλουθες δαπάνες.

α. Τις δαπάνες του υλικοτεχνικού εξοπλισμού και του προσωπικού που τοποθετείται στο Στρατηγείο πέραν του υλικοτεχνικού εξοπλισμού και του προσκοπικού που παρέχει το Εθνος – πλαίσιο.

β. Το κόστος των συστημάτων πληροφορικής και επικοινωνίας, που συνεπάγονται εθνικές ανάγκες.

γ. Το επιπλέον κόστος που συνδέεται με τις ειδικές εγκαταστάσεις από τον ειδικό υλικοτεχνικό εξοπλισμό που ενδεχομένως απαιτείται προς αντιμετώπιση των εθνικών αναγκών (συμπεριλαμβανομένων των κτιρίων και των εγκατάστασεων για άθληση και ψυχαγωγία), καθώς και τις ίδιες λειτουργικές δαπάνες Συμβάλλοντος Κράτους, που είναι δυνατόν να ζητηθούν ξεχωριστά από το Εθνος – πλαίσιο.

8.10 Το Εθνος – πλαίσιο δεν θα θεωρείται υπεύθυνο για τις δαπάνες οι οποίες αφορούν τα πρόσωπα τα οποία βαρύνουν το προσωπικό των Συμβαλλόντων Κρατών

8.11 Εν καιρώ ειρήνης, σε περίοδο κρίσεως ή κατά τη διάρκεια των επιχειρήσεων, το Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) είναι επίσης ανοικτό στην οικονομική συνεισφορά των Κρατών – μελών του NATO ή της Ευρωπαϊκής Ενώσεως, ανεξαρτήτως εάν προσωπικό των Κρατών αυτών είναι ενσωματωμένο ή όχι στη δομή αυτή. Οι εν λόγω συνεισφορές αποστέλλονται στο Εθνος – πλαίσιο, το οποίο τις θέτει στη διάθεση του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), βάσει διεθνούς δεσμεύσεως η οποία έχει αναληφθεί μετά του Κράτους ή του οργανισμού που παρέχει την εν λόγω συνεισφορά.
Άρθρο 9
Συμβουλευτική Επιτροπή

9.1 Εφόσον χρειάζεται, οι εκπρόσωποι των Συμβαλλόντων Κρατών και των υπογραφόντων συνέρχονται στο πλαίσιο συμβουλευτικής επιτροπής, υπό την προεδρία του Εθνους – πλαισίου, προκειμένου να συζητήσουν θέματα σχετικά με την παρούσα διευθέτηση, καθώς και άλλα θέματα που αφορούν το επιτελείο. Η Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) δύναται να μεταβιβάζει την εξουσία του σε διαπιστευμένο εκπρόσωπο του NATO.
Άρθρο 10
Οικονομική διαχείριση

10.1 Η διοικητική και οικονομική διαχείριση πραγματοποιείται σύμφωνα με τις διαδικασίες και κανονισμούς οικονομικής φύσεως που ισχύουν στην επικράτεια του Εθνους – πλαισίου.

10.2 Στην περίπτωση πιστώσεων από οικονομική συνεισφορά του NATO, η διοικητική και οικονομική διαχείριση πραγματοποιείται σύμφωνα με τις διαδικασίες οικονομικής φύσεως οι οποίες εφαρμόζονται στα πλαίσια του NATO.

10.3 Στην περίπτωση πιστώσεων από οικονομική συνεισφορά του NATO, τα δικαιολογητικά της συναλλαγής διαβιβάζονται στην αρμόδια στρατηγική διοίκηση, η οποία υποδεικνύει τον αρμόδιο για τον έλεγχο της διαχειρίσεως οργανισμό (Διεθνές Σώμα Ορκωτών Λογιστών του NATO, Υπηρεσία Λογιστικού Ελέγχου και Επιθεωρήσεως της Ανώτατης Διοίκησης Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) ή οργανισμός εσωτερικού ελέγχου της Διοικήσεως Μεικτών Συμμαχικών Δυνάμεων (JFC). Οι συναλλαγές αυτές αποτελούν αντικείμενο ελέγχου κατά τις ισχύουσες στο NATO διαδικασίες.
Άρθρο 11
Υλικοτεχνικός εξοπλισμός και υποδομές

11 1.1 Από το Εθνος – πλαίσιο, δωρεάν.

11 1.2 Τα περιουσιακά στοιχεία και ο υλικοτεχνικός εξοπλισμός που χρηματοδοτούνται από το NATO παραμένουν στην κυριότητα του και δεν πρέπει να χρησιμοποιούνται για σκοπούς άλλους από εκείνους του NATO (επιχειρήσεις, ασκήσεις ή άλλες δραστηριότητες) χωρίς την προηγούμενη άδεια της αρμοδίας στρατηγικής διοικήσεως.

11.2 Ο υλικοτεχνικός εξοπλισμός ο οποίος παρέχεται δωρεάν στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεαις Γαλλίας (HQ COMFRMARFOR) από Συμβάλλον Κράτος, παραμένει στην κυριότητα του τελευταίου.
Άρθρο 12
Τελικές Διατάξεις

12.1 Τροπολογίες

12.1.1 Για κάθε τροπολογία ή τροποποίηση ενός εκ των άρθρων της παρούσης τεχνικής διευθετήσεως ή του Παραρτήματος Β αυτής, απαιτείται η έγγραφη έγκριση των υπογραφόντων.

12.1.2 Οι τροποποιήσεις του Παραρτήματος Α επιφέρονται σύμφωνα με τις διατάξεις του Αρθρου V της παρούσης τεχνικής διευθετήσεως.

12.2 Κάθε διαφορά η οποία αφορά την ερμηνεία ή την εφαρμογή της παρούσης τεχνικής διευθετήσεως, επιλύεται με διαπραγμάτευση μεταξύ των υπογραφόντων και των Συμβαλλόντων Κρατών.

12.3 Εναρξη ισχύος

12.3.1 Η παρούσα τεχνική διευθέτηση τίθεται σε ισχύ κατά την ημερομηνία της τελευταίας υπογραφής.

12.3.2 Κάθε υπογράφων διαθέτει ένα πρωτότυπο αντίτυπο της παρούσης τεχνικής διευθετήσεως ως και ένα αντίγραφο κάθε κοινοποιήσεοης προσχωρήσεως. Σε κάθε Συμβάλλον Κράτος αποστέλλεται από την Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) ένα επικυρωμένο αντίγραφο της διευθετήσεως.

12.3.3 Τρίτα Κράτη, μέλη του NATO ή της Ευρωπαϊκής Ενώσεως, δύνανται να προσχωρήσουν στην παρούσα τεχνική διευθέτηση δια κοινοποιήσεως προσχωρήσεως η οποία συντάσσεται σύμφωνα με το προτεινόμενο στο Παράρτημα Γ` υπόδειγμα και υπόκειται στην έγκριση του Εθνους – πλαισίου. Η κοινοποίηση πρόσχωσησεος τίθεται σε ισχύ από της λήψεως της από το Εθνος – πλαίσιο. Το Εθνος – πλαίσιο εξασοαλίζει τη διαβίβαση της εν λόγω κοινοποιήσεως προσχωρήσεως στην Ανώτατη Διοίκηση Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) και στα λοιπά Συμβάλλοντα Κράτη. 12.4 Λήξη και απόσυρση της παρούσης τεχνικής διευθετήσεως.

12.4.1 Η παρούσα τεχνική διευθέτηση δύναται να λήξει κατά πάντα χρόνο δι` ομοφώνου συμφωνίας των υπογραφόντων. Κάθε Συμβάλλον Κράτος δύναται να αποσυρθεί από την παρούσα τεχνική διευθέτηση κατόπιν προειδοποιήσεως, η οποία λαμβάνει χώρα 12 μήνες πριν και πρέπει να κοινοποιείται σε όλους τους υπογράφοντες. Η φιλοξενούσα χώρα υποχρεούται να ενημερώνει σχετικά τα λοιπά Συμβάλλοντα Κράτη.

12.4.2 Σε περίπτωση αποσύρσεως, η Συμβουλευτική Επιτροπή συνεδριάζει για να εξετάσει τις μεταβολές τις οποίες πρέπει να επιφέρει στον πίνακα προσωπικού (Παράρτημα Α) καθώς και τις λοιπές ενδεχόμενες συνέπειες της αποφάσεως αυτής.

12.4.3 Με τη λήξη της τεχνικής διευθετήσεως, δεν απαλλάσσονται οι υπογράφοντες και τα Συμβάλλοντα Κράτη από τις υποχρεώσεις οι οποίες απορρέουν από την εκτέλεση αυτής. Συντάχθηκε σε δύο αντίτυπα, ένα στη Γαλλική γλώσσα και ένα στην Αγγλική γλώσσα, των δύο κειμένων όντων εξίσου αυθεντικών.

ΥΠΟΣΤΗΡΙΞΗ ΕΚ ΜΕΡΟΥΣ ΤΟΥ ΕΘΝΟΥΣ – ΠΛΑΙΣΙΟΥ

Υπό την επιφύλαξη των νόμων και κανονισμών οι οποίοι ισχύουν στην επικράτεια του καθώς και των διαθεσίμων μέσων, το Εθνος – πλαίσιο εγγυάται την υποστήριξη και τις υπηρεσίες εφοδιαστικής (logistics), σύμφωνα με τις διατάξεις του παρόντος Παραρτήματος.

1. Υποστήριξη και υπηρεσίες που δεν συνεπάγονται πληρωμή δαπανών :

1.1 ΥΠΟΣΤΗΡΙΞΗ ΤΟΥ ΣΤΡΑΤΗΓΕΙΟΥ

1.1 1 Το Εθνος – πλαίσιο διαθέτει το Στρατηγείο, το οποίο είναι εξοπλισμένο με πλατφόρμα ναυτικής διοικήσεως δυνάμενη να αναπτυχθεί, καθώς και τις απαραίτητες χερσαίες εγκαταστάσεις.

1.1.2 Σύμφωνα με τις διατάξεις των άρθρων VII και XI, το Εθνος – πλαίσιο αναλαμβάνει τις ακόλουθες μορφές υποστηρίξεως καθώς και τις δαπάνες τις οποίες συνεπάγεται: α) συστήματα πληροφορικής και επικοινίονίας που εξασφαλίζουν την υποστήριξη της δομής του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) εν καιρώ ειρήνης καθώς και κατά τη διάρκεια των αναπτύξεων και επιχειρήσεων,

β) παροχή επίπλων και υπολογιστών για τα γραφεία του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) (συμπεριλαμβανομένης της συντηρήσεως, της επισκευής και της αντικαταστάσεως του εξοπλισμού γραφείου),

γ) συντήρηση και εργασίες που αφορούν τα συστήματα και τις υποδομές του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR),

δ) οχήματα τα οποία χρησιμοποιούνται από το προσωπικό κατά την άσκηση των καθηκόντων του,

ε) πρόληψη και προστασία από πυρκαγιά, και υλικοτεχνικός εξοπλισμός και υποστήριξη – σε επίπεδο εφοδιαστικής – της μάχης σε περίπτωση αναπτύξεως,

στ) ασφάλεια, συμπεριλαμβανομένου του εποπτικού προσωπικού.

1.2 ΥΠΟΣΤΗΡΙΞΗ ΤΟΥ ΠΡΟΣΩΠΙΚΟΥ ΤΟΥ ΣΤΑΤΗΓΕΙΟΥ Το Εθνος – πλαίσιο παρέχει στα Συμβάλλοντα Κράτη και στο προσωπικό την ακόλουθη υποστήριξη.

α) τις μορφές υποστηρίξεως και τις υπηρεσίες οι οποίες αναφέρονται αναλυτικά στο άρθρο VII,

β) συνδρομή προς εξεύρεση καταλλήλων καταλυμάτων στον ιδκοτικό τομέα, εάν το Εθνος – πλαίσιο δεν είναι σε θέση να προσφέρει κατάλυμα στο προσωπικό και στα βαρύνοντα αυτό πρόσωπα ή όταν το ζητά το Συμβάλλον Κράτος,

γ) βοήθεια όσον αφορά την εκπαίδευση των παιδιών σχολικής ηλικίας – προστατευόμενα μέλη.

2. Υποστήριξη και υπηρεσίες που συνεπάγονται πληρωμή δαπανών :

2.1 Υποστήριξη, τις δαπάνες της οποίας αναλαμβάνουν τα Συμβάλλοντα Κράτη Ούτε το Εθνος – πλαίσιο ούτε οι λοιποί υπογράφοντες δεν πρέπει να προσπορίζονται οφέλη από τις επίσημες δραστηριότητες του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) ή του προσωπικού του με διεθνές καθεστώς. Οι αιτήσεις πληρωμής που απευθύνει το Εθνος – πλαίσιο προς τα Συμβάλλοντα Κράτη για την υποστήριξη την οποία εξασφαλίζει στο προσωπικό τους το οποίο είναι τοποθετημένο στο Στρατηγείο Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), δεν δύνανται να αφορούν παρά μόνον τις δαπάνες που πράγματι πραγματοποίησε το Εθνος – πλαίσιο. Το Εθνος – πλαίσιο εξασφαλίζει, έναντι καταβολής των δαπανών, στο προσωπικό των Συμβαλλόντων Κρατών και στα πρόσωπα που προσλαμβάνουν, τις κάτωθι περιγραφόμενες υπηρεσίες :

α) ιατροφαρμακευτική περίθαλψη σε περίπτωση επειγόντων περιστατικών (εν ανάγκη, επαναπατρισμός, σύμφωνα με τις διατάξεις του STANAG 2061),

β) εάν το ζητήσουν τα Συμβάλλοντα Κράτη, ιατρικές επισκέψεις και συνήθεις εκ των προτέρων εμβολιασμούς του προσωπικού το οποίο στέλλεται σε αποστολή, πριν από ανάπτυξη ή επιβίβαση επί πλοίου.

2.2 Υποστήριξη του προσωπικού, η οποία συνεπάγεται πληρωμή δαπανών Είναι πληρωτέα από τον χρήση οι ατομικές δαπάνες, τα πρόστιμα και οι οφειλές. Η υποστήριξη και οι υπηρεσίες οι οποίες εξασφαλίζονται στο προσωπικό από το Εθνος – πλαίσιο έναντι πληρωμής των δαπανών από τον δικαιούχο, περιλαμβάνουν :

α) γεύματα : το προσωπικό των Συμβαλλόντων Κρατών τύγχανε, των αυτών συνθηκών με το προσωπικό του Εθνους – πλαισίου, του αντιστοίχου βαθμού, τόσο στη ξηρά όσο και κατά τη διάρκεια των αναπτύξεων,

β) το προσωπικό των Συμβαλλόντων Κρατών, όπως και τα πρόσωπα που το βαρύνουν, έχουν πρόσβαση στις εγκαταστάσεις οι οποίες προορίζονται για κοινωνικές, ψυχαγωγικές και άλλες συναφείς δραστηριότητες, υπό τις αυτές προϋποθέσεις και συνθήκες που ισχύουν και για το προσωπικό του Εθνους – πλαισίου,

γ) πρόσβαση στις λέσχες των αξιοκρατικών και υπαξιωματικών που διαθέτει το Εθνος – πλαίσιο στο αντιστοίχου βαθμού προσωπικό του,

δ) κατάλυμα : το προσωπικό των διαφόρων Συμβαλλόντων Κρατών υποχρεούται να καταβάλλει ολόκληρο το ποσό του ενοικίου, καθώς και τις συναφείς δαπάνες.

2.3 Τιμολόγηση :

2.3.1 Τα τιμολόγια και οι λογαριασμοί για τις περιγραφόμενες στις ως άνω παραγράφους 2.1 και 2.2 παραγράφους, εκδίδονται σε ευρώ.

2.3.2 Το Εθνος – πλαίσιο μεριμνά για την έγκαιρη έκδοση των τιμολογίων, σύμφωνα με τα συμπεφωνημένα με κάθε Κράτος μέρος στην παρούσας τεχνική διευθέτηση.

ΚΟΙΝΟΠΟΙΗΣΗ ΠΡΟΣΧΩΡΗΣΕΩΣ ΣΤΗΝ ΤΕΧΝΙΚΗ ΔΙΕΥΘΕΤΗΣΗ ΕΠΙ ΤΗΣ ΕΠΑΝΔΡΩΣΕΩΣ, ΧΡΗΜΑΤΟΔΟΤΗΣΕΩΣ, ΔΙΟΙΚΗΣΕΩΣ ΚΑΙ ΥΠΟΣΤΗΡΙΞΕΩΣ ΤΟΥ ΣΤΡΑΤΗΓΕΙΟΥ ΔΙΟΙΚΗΣΕΩΣ ΤΗΣ ΝΑΥΤΓΚΗΣ ΔΥΝΑΜΕΩΣ ΓΑΛΛΙΑΣ (HQ COMFRMARFOR) ΜΕ ΤΗΝ ΙΔΙΟΤΗΤΑ ΤΟΥ ΣΤΡΑΤΗΓΕΙΟΥ ΔΙΟΙΚΗΣΕΩΣ ΝΑΥΤΙΚΗΣ ΔΥΝΑΜΕΩΣ ΤΑΧΕΙΑΣ ΑΝΑΠΤΥΞΕΩΣ TOY NATO (HQ NRDMCC)

Ο Υπουργός Αμυνας (ή άλλη αρμόδια αρχή) … του [Συμβάλλοντος Κράτους], όπως εκπροσωπείται από … έχοντας αποφασίσει τη συμμετοχή των ενόπλων δυνάμεων του στην Επάνδρωση, τη Χρηματοδότηση και την υποστήριξη του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR), εν σχέσει προς τις επιχειρήσεις και τις ασκήσεις του NATO και του PfP στο γενικό πλαίσιο της πολιτικής του NATO, δηλώνει ότι προσχωρεί στην τεχνική διευθέτηση η οποία συνήφθη μεταξύ του Υπουργού Αμυνας της Γαλλικής Δημοκρατίας και της Ανώτατης Διοίκησης των Συμμαχικών Δυνάμεων Ευρώπης (SHAPE) επί της επανδρώσεως, χρηματοδοτήσεως, διοικήσεως και υποστηρίξεως του Στρατηγείου Διοικήσεως της Ναυτικής Δυνάμεως Γαλλίας (HQ COMFRMARFOR) με την ιδιότητα του Στρατηγείου Διοικήσεως Ναυτικής Δυνάμεως Ταχείας Αναπτύξεως του NATO (HQ NRDMCC), η οποία υπεγράφη στις …, ως εξής: ως Συμβάλλον Κράτος, όσον αφορά την Επάνδρωση, τη Χρηματοδότηση και την υποστήριξη, σύμφωνα με τις διατάξεις της προαναφερόμενης τεχνικής διευθετήσεως, και δεσμεύεται ότι θα την τηρεί από […] Για τον Υπουργό Εθνικής Αμύνης της / του (Συμβάλλον Κράτος) Ημερομηνία :

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Τεχνικής Διευθέτησης, που κυρώνεται, σύμφωνα με τις συνταγματικές διαδικασίες. Οι τροποποιήσεις του Παραρτήματος Α` επιφέρονται σύμφωνα με τις διατάξεις του άρθρου V της παρούσας Τεχνικής Διευθέτησης.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεση του ως νόμου του Κράτους.
